Saba (BES Islands) Trademark Registration

Trademark protection is obtained by registration.

Trademark Law:

As from October 10th, 2010, the Netherlands Antilles ceased to exist as a political entity. The islands of Bonaire, Saint Eustatius and Saba (“BES islands“) have become part of the Netherlands. These islands, also called Caribbean Netherlands, have become special individual municipalities within the Kingdom of the Netherlands.

A trademark application has to be filed before the Benelux Office for Intellectual Property (BOIP) by a local agent. No notarization nor legalization required for the Power of Attorney. Foreign applicants do not need a domestic registration.

The application process includes a formal examination, an examination of distinctiveness and a search for prior trademarks. It takes approximately 8-12 months from first filing to registration. Prior to registration, the trademark application must be published in the official gazette within a period of 60 working days. The opposition period is 60 working days from publication date of the application.

A trademark registration in Saba
is valid for 10 years and starts with registration date. The registration is renewable for periods of 10 years.

Duly note, if the trademark has not been used within 3 years from issue of the registration certificate or has not been used later for a continuous period of 3 years, it may be subject to cancellation.
